What is a final demand?
A final demand is the last reminder that payment of a debt is due.
How do I use a final demand?
The final demand is used to get the ATTENTION of your non-payer.
A final demand works best when sent shortly after your last in-house contact with your debtor and should include a deadline. Most creditors use 7 or 14 days.
The use of a final demand tells your debtor that this is the time for them to speak up before you manage them as a won't pay and take further action.
How do I write a final demand?
Collect together the name and address for your debtor, the amount due, the dates involved with your claim such as starting date of debt, and your supporting documentation usually your invoices and your statement.
Use these facts to write a clear statement explaining the monies owed to you. Explain who owes what and the reason the debt is due for example non-payment of invoice and then detail the actions you have taken to resolve the circumstances. Close by asking for payment.
What should follow a final demand?
A final demand is ineffective if you threaten to send an account to collections or court within a certain amount of time and fail to do so.
Our pre-action® ADR® service delivers your final demand. It uses pre-legal legislative power to get you your money.
In parallel it prepares your money claim ready for immediate court issue if the debtor fails to comply with their obligations so ensuring you can move swiftly while fulfilling pre-action protocol and providing evidence of the offer of proportionate alternative dispute resolution.
